Product errors
Product defects
An essential legal basis for materials testing is the Product Liability Act (Produkthaftungsgesetz, Gesetz über die Haftung für fehlerhafte Produkte – ProdHaftG) of 15 December 1989 (Federal Law Gazette/p. 2198). Section 3 of this Act defines the term ‘defect’ as follows:
A product has a defect if it does not offer the safety that can reasonably be expected, taking into account all circumstances, in particular
a) its presentation,
b) the use that can reasonably be expected
c) the time at which it was placed on the market.
According to ISO 9000, a defect is defined as non-conformity, i.e. failure to meet specified requirements. The following measures are required for material and polymer testing under the Product Liability Act:
- Selection of application-related, relevant and meaningful test procedures and methods
- Test-appropriate or test-friendly design and manufacture
- Testing with agreed, meaningful procedures
- Evaluation of test results with regard to intended use
- Product and process monitoring, preventive error prevention and, if necessary, damage analysis (see also: damage analysis plastic products, VDI Guideline 3822).
