An essential legal basis for [[Materials Testing|materials testing]] is the Product Liability Act (Produkthaftungsgesetz, Gesetz über die Haftung für fehlerhafte Produkte – ProdHaftG) of 15 December 1989 (Federal Law Gazette/p. 2198). Section 3 of this Act defines the term ‘defect’ as follows: &lt;br /&gt;
&lt;br /&gt;
A product has a defect if it does not offer the safety that can reasonably be expected, taking into account all circumstances, in particular &lt;br /&gt;
&lt;br /&gt;
a)     its presentation, &lt;br /&gt;
&lt;br /&gt;
b)     the use that can reasonably be expected &lt;br /&gt;
&lt;br /&gt;
c)     the time at which it was placed on the market. &lt;br /&gt;
&lt;br /&gt;
According to ISO 9000, a defect is defined as non-conformity, i.e. failure to meet specified requirements. The following measures are required for [[Material &amp;amp; Werkstoff|material]] and [[Polymer Testing|polymer testing]] under the Product Liability Act:&lt;br /&gt;
&lt;br /&gt;
* Selection of application-related, relevant and meaningful test procedures and methods&lt;br /&gt;
* Test-appropriate or test-friendly design and manufacture&lt;br /&gt;
* [[Testing]] with agreed, meaningful procedures&lt;br /&gt;
* Evaluation of test results with regard to intended use&lt;br /&gt;
* Product and process monitoring, [[Failure Analysis – Basics|preventive error prevention]] and, if necessary, damage analysis (see also: [[Failure Analysis Plastics Products, VDI Guideline 3822|damage analysis plastic products, VDI Guideline 3822]]).&lt;br /&gt;
